Agency for Health Care Administration to Survey Providers
The
Agency for Health Care Administration has implemented a
program to survey the provider community in an attempt to
improve their level of customer service. The Agency is now
surveying Medicaid providers to gain their feedback, and
last day to file a response on the survey will be February
8, 2008. The Agency for Health Care Administration is the
governmental agency responsible for the administration of
Florida's Medicaid program.
This is your opportunity for the Agency to hear directly
from FPA members and health care professionals working
daily to provide quality health care to Medicaid
beneficiaries. If you are a Medicaid provider take a few
minutes to take the on-line survey. The survey can be

Change in Medicaid Fiscal
Agent Delayed Until July 2008
In
May 2006, the Agency for Health Care Administration (AHCA)
announced a signed contractual agreement with Electronic
Data Systems (EDS) to develop a new Medicaid computer system
and serve as the State’s fiscal agent for five years
beginning March 1, 2008. The Florida Pharmacy Association
has learned that there will be a delay in transition to EDS.
The new transition date has been scheduled for July of 2008.
Medicaid officials and EDS will be available to answer
questions during the FPA law conference in Sandestin in
February.
The new Medicaid system, referred to as the Florida Medicaid
Management Information System/Decision Support System (FMMIS/DSS),
will replace the current system supporting claims processing
and will include Web Portals for Medicaid providers and
recipients. The Web Portal will allow providers to file and
reconcile claims, perform eligibility verification, access
information on the care given to Medicaid recipients, and
automate numerous other administrative functions in the new
system. The recipient Web Portal, available in Spanish and
English, will allow recipients to access their Medicaid
claims history, make provider choices, and report on fraud
and abuse.
In addition, the new system will offer flexible technology
to support Medicaid reform and timely access of information
to facilitate effective measurement of recipient health
outcomes and policy decisions and services for both
providers and recipients.
Florida
Pharmacist Immunization Rule Scheduled to Take Effect
The Board of Pharmacy has been working to write rules
related to pharmacists immunization services. The
Florida Legislature during the 2007 session passed House
Bill 543 allowing Florida licensed pharmacists to provide
influenza immunization services under certain circumstances.
Text of the proposed rule is as follows:
64B16-26.1031 Influenza Immunization Certification Program.
The Board shall approve for initial certification of
pharmacist administration of influenza immunizations,
programs of study not less than 20 hours that includes
coursework covering all of the following;
(1) Mechanisms of action for vaccines, contraindications,
drug interactions, and monitoring after vaccine
administration;
(2) Immunization Schedules;
(3) Immunization screening questions, provision of
risk/benefit information, informed consent, recordkeeping,
and electronic reporting into the statewide immunization
registry through enrollment application DH Form 1997 herein
incorporated by reference;
(4) Vaccine storage and handling;
(5) Bio-Hazardous waste disposal and sterile techniques;
(6) Entering, negotiating and performing pursuant to
physician oversight protocols;
(7) Community immunization resources and programs;
(8) Identifying, managing and responding to adverse
incidents including but not limited to potential allergic
reactions associated with vaccine administration;
(9) Procedures and policies for reporting adverse events to
the Vaccine Adverse Event Reporting System (VAERS);
(10) Reimbursement procedures and vaccine coverage by
federal, state and local governmental jurisdictions and
private third party payors;
(11) Administration techniques;
(12) The current influenza immunization guidelines and
recommendations of the United States Department of Health
Centers for Disease Control and Prevention;
(13) Review of Section 465.189, F.S.; and
(14) Cardiopulmonary Resuscitation (CPR) training.
Successful completion of the certification program must
include a successful demonstration of competency in the
administration technique and a cognitive examination.

This rule, barring any requests for hearing or comments from
the Joint Administrative Procedures Council (JAPC), should
be adopted on February 15, 2008 and become effective on
March 6, 2008. The Florida Pharmacy Association wish
to thank the Department of Health and the Board of Pharmacy
for their efforts to move this rule forward.
Florida
Pharmacists Legislative Day and Health Fair - March 5 -
6, 2008
Call for Volunteers
Florida's
pharmacists will be hosting a health fair on the first
floor of the Florida Capitol on Thursday, March 6, 2008 in
Tallahassee, Florida. Health screenings being
offered include cholesterol and blood glucose monitoring,
blood pressure, body composition analysis, risk assessment
of breast, colorectal and ovarian cancer as well as
medication reviews. Plans are for all fees collected
for the screenings to be donated to the American
Cancer Society and the American Heart Association.
The screenings are schedule to begin at 9:00am and
conclude at 2:00pm. The general public is invited.
Members wishing to participate in the program being
presented by pharmacists and pharmacy students should
contact the FPA office at (850) 222-2400.
On March 5, 2008 pharmacists and pharmacy students from
across Florida will be coming to Tallahassee to spend the
day at the Florida Capitol to advocate on various pharmacy
issues. Members will have an opportunity to visit
their legislators, attend scheduled committee meetings and
observe legislative discussions on the floor of the House
or Senate. A continuing education program has been
scheduled the evening of March 5th at the Park Plaza
Hotel, 415 North Monroe Street, Tallahassee, Florida
32301.

Pharmacist
Technician Bill on Committee Senate Committee Agenda
Senate
Bill 334 sponsored by Senator Burt Saunders (Rep -
Naples, Cape Coral) has been placed on the agenda for
consideration by the Senate Health Regulation Committee.
The Committee will be meeting on Wednesday, February 6,
2008 in room 401 of the Senate Office Building. This
bill was place on the agenda of the Health Regulation's
previous committee meeting where the bill was completely
revised removing all of the language requiring
pharmacist technicians to register with the Department of
Health and be certified. The bill was then
temporarily postponed until consideration at the scheduled Wednesday
meeting. The only issue now on the bill is a
measure to remove the 12 year NAPLEX examination
requirement for pharmacists who wish to transfer their
licenses to Florida. If signed into law by Governor
Crist pharmacists who wish to transfer their licenses will
no longer need to have to take the NAPLEX licensure
examination within the last 12 years preceding
application. This bill in its present form is not
supported by the Florida Pharmacy Association.
The House version of the bill HB
275 related to pharmacist technician was work shopped
on January 8th in the House Health Quality Committee. Some Committee
members raised concerns that the draft legislation did not
go far enough.

video link. Some of the provisions in this bill
include the following:

Removal of the requirement for pharmacists who wish to
transfer their licenses to Florida from having to take
and successfully passed the NAPLEX examination within
the last 12 years.
 |
Create a requirement for pharmacy technicians to
register with the Florida Board of pharmacy
 |
Increase the number of technicians that a pharmacy can
supervise from a maximum of 3 to a maximum of 4.
 |
Pharmacies with 4 technicians will be required to have
one of the four technicians certified by the Pharmacy
Technician Certification Board or other Board approved
certifying body.
 |
Requires a fee no greater than $50 to be submitted to
the Department of Health from individuals wishing to
register as a pharmacy technician.
 |
Pharmacists with discipline would not be permitted to
register as a technician.
 |
Exempts pharmacy technician students from having to
register with the Department as a pharmacy technician.
 |
Allows pharmacy students to be employed as a
technician without having to register with the
Department as a registered technician.
 |
Requires registered technicians to satisfy continuing
education requirements
 |
Requires pharmacies to display the technician’s
registration information.
 |
Gives the Board of Pharmacy disciplinary authority
over registered technicians who violate the law.
 |
Requires the Board of Pharmacy to publish the
employment location of pharmacy technicians.

A third version of draft pharmacist technician
legislation has been filed on the Senate side.
Senate bill 1360 by Senator Durell Peaden (Rep -
Crestview) has language supported by both the Florida
Pharmacy Association and the Florida Society of
Health-System Pharmacists.
Bill
Filed to Revise Orthotic, Prosthetic and Pedorthic
Services
The Association has learned that House
bill 607 has been filed to revise laws related to
Orthotic, Prosthetic and Pedorthic Services. There
are some pharmacy providers that been delivering
these services under laws written 1997 that excluded
pharmacists from having to register under Florida
Statutes 468. The draft language in the bill appears
to remove the exemption in favor of allowing other health
care providers deliver Orthotic and Prosthetic (O & P)
services if their practice act says so. The
Association will monitor this legislation very closely to
see its impact on existing O & P pharmacy providers.
House and
Senate Bill to Set Standards on Dispensing of
Emergency Contraceptives
Of interest to the members is language in Senate
bill 780 and House
bill 385. Both these bills if passed into law places
obligations on pharmacists to ensure access to emergency
contraceptive products. Some of the provisions in these
bills include the following:

Pharmacies that have emergency contraceptive products
in stock should provide the medication without delay
 |
Pharmacies that do not have the emergency
contraceptive product in stock would be obligated to
provide options to the patient such as referral and
transfer of the prescription to another pharmacy. If
the patient prefers that the pharmacy order the
product then the pharmacy would be obligated to do so.
 |
A pharmacy must ensure that patients requesting these
services are not harassed, intimidated or threaten.
The pharmacy must also insure that employees do not
obstruct the delivery of these services to the
patient. The pharmacy would be prohibited from
deceiving a patient about the availability of the
product.

The legislation does not seem to interfere with a
pharmacist’s personal belief on this issue rather it
places a legal requirement on the pharmacy to ensure that
emergency contraceptive services are provided without any
barriers.
Requirements
for Log Books for the Sale of Ephedrine Products to be
considered by Florida Legislature
Senate
Bill 1388 has been filed to require retail
establishments (including pharmacies) who sell ephedrine
and related compounds to maintain purchasing log books.
The bill directs the Department of Health to provide
"electronic" log books to retail distributors
subject to available funding. Members need to be
aware that there currently are requirements for pharmacies
to maintain log books under the Combat Methamphetamine

more information. There is no House companion bill
at this time. There is however a related public
records exemption bill that has been filed.
CBO
Releases Cost Estimates for Pharmacy Negotiation Bill
(From APhA)
The Congressional Budget Office (CBO) recently released
its cost estimate of the Community Pharmacy Fairness Act
of 2007 (H.R. 971). The legislation would create an
exemption to antitrust laws to permit independent
pharmacies to negotiate collectively with health plans and
issuers of health insurance over payment rates and other
contract terms. That exemption would apply to negotiations
between independent pharmacies and operators of
prescription drug plans offered under part D of Medicare.
However, the exemption would not apply to most other
federal health insurance programs.
CBO estimates that enacting the bill would cost the
government $681 million over the next five years;
additionally, CBO also estimates that the bill would
increase payments for prescription drugs distributed by
independent pharmacies by about 1 percent in 2010, when
the majority of the contracts affected by the policy would
be up for renewal and could be renegotiated.
Governor's
Proposed Budget to be released on Thursday, January 31,
2008
It is anticipated that the Governor's proposed 2008 - 2009
buget will be released on Thursday, January 31, 2008.
While we are not sure what will be in the proposal FPA
advocates are concerned with the budget reduction
exercises under way in various state agencies and in
particular at our state's universities that we will see
some significant changes anticipated in health care
funding. We do know that expansion of the Medicaid
reform program is on hold for now. Florida
legislators will be assembling in Tallahassee beginning
March 4, 2008. Their only obligation during the two
month session is to pass the spending measures necessary
to run the states. Watch for futher developments in
the Stat News.
